Suit for the recovery of this balance was tried in the United
States district court for the southern district of Ohio, in De-
cember, 1856, and a verdict of $1,500 was obtained against
Mr. Smith. Suit against his sureties was tried at December
term, 1858, and resulted in judgment in favor of the gov-
ernment for $1,500, principal, and $216 92, interest, and
costs. This being paid, satisfied both judgments; and the
accounts of Mr. Smith on the books of the department should
be closed.

This account has not been received by the Solicitor for suit.
